Heartland Home Rentals assumes no responsibility and in no way warrants the accuracy of the information contained in any of the listings published on the HeartlandHomeRentals.com website. None of the information contained in any Heartland Home Rentals property listing is confirmed or warranted in any way. Renters are responsible for conducting their own investigations regarding any and all claims made by vacation property owners or agents. We highly recommend that renters conduct their own research regarding any and all advertising on HeartlandHomeRentals.com including, but not limited to:

  • Obtaining references from past renters.
  • Visually inspecting rental properties by requesting additional photos from the owner/manager.
  • Requesting a copy of all of the property owner's policies.
  • Insisting on a rental agreement.
  • Always speaking to the owner by phone before sending any money.
  • If paying by Check or Money Order, taking additional precations and try to avoid using wire transfers.
  • Checking with the Better Business Bureau
  • Purchasing trip insurance.

Heartland Home Rentals highly recommends that renters ask for and receive, review and understand a written notice of the Refund/Cancellation policy from the advertiser. Heartland Home Rentals is not responsible for the refund of rental fees for any reason.

Renters assume all liability for use of any information found on the HeartlandHomeRentals.com website. By using or continuing to use the services of Heartland Home Rentals you agree to the terms and conditions of this disclaimer.

Heartland Home Rentals is not involved in any transaction between any party who uses the HeartlandHomeRentals.com website. As a result, Heartland Home Rentals has no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, or the ability of the renters to rent accommodations. Heartland Home Rentals cannot ensure that an owner will complete the transaction.

Owners/agents may update their listing information online at any time. Heartland Home Rentals expects owners to provide truthful and accurate information, but cannot ensure this, or control the behavior of owners/agents listing on our site. By use of this site, you agree to accept these risks.

Heartland Home Rentals does not participate in or tolerate the sending of Unsolicited Commercial Email (SPAM). Heartland Home Rentals has no control over the behavior of users of the HeartlandHomeRentals.com website and cannot be held responsible for any SPAM that is received as a result of using this site.

Heartland Home Rentals is not a licensed real estate broker in any state and is not acting as the property management agent for any property owner.

Notice to Property Owners

Property owners bear the sole responsibility of qualification of all renters. Property owners are responsible for conducting their own investigations regarding any and all claims made by prospective renters.

Heartland Home Rentals is not involved in any transaction between any party who uses the HeartlandHomeRentals.com website. As a result, Heartland Home Rentals has no control over the the ability of owners to rent the accommodations. Heartland Home Rentals cannot ensure that a renter will complete the transaction. Heartland Home Rentals is not responsible for any action, or omission of action, by any renter obtained by the use of this site.

Owners/agents may update their listing information online at any time. Owners are responsible for the accuracy of the information on their property listings. Heartland Home Rentals expects owners to post fair and professional property lisings including, but not limited to:

  • Providing truthful and accurate information.
  • Providing accurate and recent photos of the property whenever photos are included in a listing.
  • Having the publishing rights to all photos used in a listing.
  • Not using all capital letters ("shouting").
  • Not including any comments that contain vulgarity, or comments related to violence, hate, or references of a sexual nature.
  • Not including any computer code with the exception of the HTML tags a, b, i, u, and br.
  • Only listing properties that are available for short-term (less than one month) rentals.
  • Being the legal owner of the listed property and legally able to list it for rent.

Heartland Home Rentals reserves the right to edit listings for style, content, length, or any other reason. Heartland Home Rentals reserves the right to delist any vacation rental at its discretion and cancel service without notification. No refund will be given for cancelled listings.

Rental inquires are delivered via Internet email and are not to be considered private. Internet e-mail delivery is not 100% reliable and Heartland Home Rentals cannot be held responsible for undelivered inquiries or for missed income as a result of undelivered inquiries.

Heartland Home Rentals does not participate in or tolerate the sending of Unsolicited Commercial Email (SPAM) - Heartland Home Rentals reserves the right to cancel (without refund) any member that mentions Heartland Home Rentals or any of its associated websites, URLs, or any associated Heartland Home Rentals email address in any SPAM e-mail message or Usenet posting. Heartland Home Rentals is the sole judge in determining what constitutes SPAM. Heartland Home Rentals cannot be held responsible for any SPAM that property owners may receive as a result of using this site.

Without limiting any other remedies, Heartland Home Rentals may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the HeartlandHomeRentals.com website.

Heartland Home Rentals is not a licensed real estate broker in any state and is not acting as the property management agent for any property owner.

Disclaimer of Warranty

HEARTLAND HOME RENTALS DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES WITH REGARD TO THE INFORMATION, SERVICES, AND MATERIALS CONTAINED ON THIS SITE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALL SUCH INFORMATION, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

Limitation of Liability

IN NO EVENT SHALL HEARTLAND HOME RENTALS BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, BUSINESS, DATA OR PROFITS, LITIGATION AND THE LIKE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE SITE WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS. SOME STATE STATUTES MIGHT APPLY REGARDING LIMITATION OF LIABILITY.

Indemnification

You agree to indemnify, defend and hold harmless Heartland Home Rentals, its affiliates and suppliers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (i) your violation of this agreement, and (ii) your posting of material to this site.

Proprietary Rights

All materials on this site, including property information and photos, (as well as the organization and layout of the site) are owned and copyrighted by Heartland Home Rentals or its suppliers and may be accessed, downloaded or printed for your personal non-commercial use only. Without the prior written permission of Heartland Home Rentals or its suppliers, you may not copy, distribute or transfer any material on this site, except for property information and photos, for in whole or in part.

Changes to Site

Heartland Home Rentals and its suppliers may make improvements or changes in the information, services, products, and other materials on this site, or terminate this site, at any time without notice. Heartland Home Rentals may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement. Accordingly, you agree to review the agreement periodically, and your continued access or use of this site shall be deemed your acceptance of the modified agreement.

Miscellaneous

This agreement and the resolution of any dispute related to this Agreement or the site shall be governed by and construed in accordance with the laws of Illinois, without giving effect to any principles of conflicts of law. Heartland Home Rental's failure to insist upon strict enforcement of any provision of this agreement shall not be construed as a waiver of any provision or right. Any legal action or proceeding between Heartland Home Rentals and you related to this agreement shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Illinois.

Heartland Home Rentals does not guarantee that the HeartlandHomeRentals.com website will be available 100% of the time.
